Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Brief product (the "Service"), provided by DSMedia ("DSMedia," "we," "our"). The natural person or legal entity using the Service is referred to as the "Operator." By accessing or using the Service the Operator agrees to be bound by these Terms.
1. The Service
Brief is an analysis and orchestration layer for digital-advertising operators. It reads data the Operator provides — whether by uploading CSV files or by connecting an advertising platform such as Google Ads — and produces structured recommendations for the Operator to evaluate. Brief does not autonomously initiate, schedule, or carry out any change to any connected advertising account, account asset, or external system. Any operation the Service is capable of performing is subject to the Human-Gated Execution mechanism described in Section 6 below.
2. Eligibility and access
The Service is currently invitation-only and intended for authorized operators (advertising managers, agency staff, or similar). You may only use the Service on advertising accounts you are authorized to operate. By using the Service, you represent that you have the necessary rights and authority over the data you submit and the accounts you connect.
3. Acceptable use
You agree not to:
- Upload or submit data you do not have the right to share.
- Use the Service to violate any law or any third party's rights, including platform terms (e.g., the Google Ads API Terms of Service).
- Attempt to reverse-engineer, scrape, or interfere with the Service.
- Use the Service to generate or distribute content that is deceptive, harmful, or designed to manipulate advertising measurement.
- Resell or sublicense the Service without our prior written consent.
4. Your content
You retain ownership of all data you submit to the Service ("Your Content"). You grant DSMedia a limited, non-exclusive license to host, process, and analyze Your Content for the sole purpose of providing the Service to you. We do not use Your Content to train models for third parties and we do not sell Your Content. See our Privacy Policy for details.
5. Third-party platforms
The Service integrates with third-party platforms, including Google Ads via the Google Ads API. Your use of those platforms is governed by their own terms (for example, the Google Ads API Terms of Service). You are responsible for complying with those terms when you connect or operate accounts through the Service.
6. Human-Gated Execution
(a) Advisory by default. Brief is an advisory and orchestration system. The Service shall not initiate, schedule, or perform any change to any connected advertising account, account asset, or external system other than as expressly authorized by the Operator in accordance with this Section.
(b) Two-step authorization. Execution of any operation by the Service requires the Operator's completion of both of the following steps for the specific recommendation in question: (i) Approval— the Operator's affirmative selection to approve that recommendation; and (ii) Confirmation— the Operator's separate, subsequent confirmation to proceed with execution.
(c) No execution absent authorization. Until both steps in subsection (b) have been completed for a given recommendation, the Service performs no execution on the Operator's behalf in respect of that recommendation. Rejection of a recommendation, or failure to confirm a previously approved recommendation, prevents execution.
(d) Scope of authorized execution. Once both authorization steps are completed for a recommendation, the Service may execute only the specific operation described in that recommendation, strictly within its stated parameters. The Service shall not extrapolate, generalize, or extend the authorization to any other recommendation, operation, account, or asset.
(e) Operator responsibility. The Operator is solely responsible for each authorized and confirmed operation and for its consequences, including any effect on advertising spend, performance, account standing, third-party platform compliance, or business outcomes. DSMedia disclaims any liability for outcomes arising from operations executed pursuant to the Operator's authorization under this Section.
7. No warranty
The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. To the maximum extent permitted by law, DSMedia disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade.
We do not warrant that the Service will be uninterrupted, error-free, or that any analysis produced by the Service will be accurate, complete, or appropriate for your situation.
8. Limitation of liability
To the maximum extent permitted by law, DSMedia's total aggregate liability arising out of or related to the Service will not exceed the greater of (a) the amount you have paid to DSMedia for the Service in the twelve months preceding the claim, or (b) one hundred US dollars (US$100). DSMedia will not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to lost profits, lost data, lost advertising opportunity, or business interruption.
9. Termination
Either party may terminate access to the Service at any time, with or without cause. On termination your access ends immediately. Provisions of these Terms that by their nature should survive (ownership, disclaimers, limitation of liability, indemnities, governing law) will survive termination.
10. Governing law
These Terms are governed by the laws of the State of Israel, without regard to its conflict-of-laws rules. The competent courts located in Tel Aviv–Yafo, Israel will have exclusive jurisdiction over any dispute arising out of or related to these Terms or the Service.
11. Changes
We may update these Terms from time to time. We will update the "Last updated" date above and, for material changes, provide additional notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
